VIOLAZIONI SULLE DICHIARAZIONI: RAVVEDIMENTO SPECIALE ENTRO IL 31 MAGGIO


Il "Decreto Milleproroghe" (DL n. 215/2023), come modificato dalla legge 23 febbraio 2024, n. 18, ha esteso l’istituto del ravvedimento speciale alle violazioni concernenti le dichiarazioni validamente presentate relative al periodo d’imposta in corso al 31 dicembre 2022. L’adesione al ravvedimento speciale si perfeziona con il versamento, entro il 31 maggio 2024, dell’intero importo dovuto, ovvero della prima rata, oltreché con la rimozione, entro lo stesso termine, delle irregolarità od omissioni che si intendono sanare. Sono escluse dal perimetro del ravvedimento speciale le violazioni che al 31 maggio sono state già contestate, comprese le comunicazioni emesse a seguito di controllo formale (“36-ter”). In caso di pagamento rateale, sulle tre rate successive alla prima (30 giugno, 30 settembre e 20 dicembre 2024) sono dovuti gli interessi nella misura del 2% annuo. La stessa scadenza del 31 maggio è valida per usufruire della riapertura dei termini, prevista dal decreto "Agevolazioni fiscali" (Dl n. 39/2024), per aderire al ravvedimento speciale con riferimento alle dichiarazioni presentate per il 2021 e per gli anni precedenti.Possono beneficiare di questa ulteriore finestra temporale sia i contribuenti che non hanno perfezionato entro la scadenza originaria (30 settembre 2023) la procedura di regolarizzazione sia coloro che, pur avendola perfezionata, intendono ora avvalersene per sanare ulteriori violazioni riferibili allo stesso anno o ad anni precedenti. La riapertura vale anche per coloro che avevano perfezionato la regolarizzazione ma sono poi decaduti dal beneficio della rateazione: possono sanare ulteriori violazioni, purché diverse da quelle già regolarizzate.Nella Circolare n. 11/E del 15 maggio l'Agenzia delle Entrate, oltre a fornire indicazioni sulle novità introdotte dai due decreti, chiarisce anche le modalità di calcolo delle somme dovute, sia in caso di pagamento in unica soluzione sia in caso di rateazione.   • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
