CERTIFICAZIONE CORRISPETTIVI: NO AL FILE RIEPILOGATIVO IN LUOGO DEI BIGLIETTI DI TRASPORTO


Con Risposta n. 98 del 23 aprile l'Agenzia delle Entrate si è espressa in tema di trasporto di persone e certificazione dei corrispettivi, in particolare riguardo alla possibile sostituzione, a fini conservativi, dei singoli biglietti di trasporto con un file riepilogativo degli stessi, da predisporre su base mensile. L'Agenzia osserva come le disposizioni normative attualmente vigenti non contengano tale previsione. Infatti, in generale, dopo l'emissione dei documenti che certificano la prestazione resa, è ammessa la sola annotazione cumulativa dei relativi corrispettivi nel registro previsto dall' articolo 24 del decreto IVA. E ­ anche laddove tale file potesse qualificarsi come un "estratto informatico" di ciascun biglietto elettronico emesso nel periodo di riferimento, va ricordato che le copie e gli estratti informatici del documento informatico, se prodotti in conformità alle vigenti Linee guida, hanno la stessa efficacia probatoria dell'originale da cui sono tratte se la loro conformità all'originale, in tutti le sue componenti, è attestata da un pubblico ufficiale a ciò autorizzato o se la conformità non è espressamente disconosciuta. Resta fermo, ove previsto, l'obbligo di conservazione dell'originale informatico. Ne deriva quindi che, laddove il pubblico ufficiale non intervenga e sussistono disposizioni volte alla conservazione dei documenti iniziali, ­la redazione/conservazione del file riepilogativo non potrebbe sostituire quella dei singoli documenti ma, al più, aggiungersi alla stessa. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
