DDL IA, IMPORTANTI DISPOSIZIONI IN MATERIA DI SANITà E DISABILITà


Il Ddl in materia di intelligenza artificiale recentemente approvato dal Consiglio dei Ministri individua criteri regolatori capaci di riequilibrare il rapporto tra le opportunità che offrono le nuove tecnologie e i rischi legati al loro uso improprio, al loro sottoutilizzo o al loro impiego dannoso.  Tra le diverse norme, il decreto prevede importanti disposizioni che mirano a regolare l'utilizzo dell'intelligenza artificiale nell'ambito della sanità e disabilità. Relativamente all'accessibilità, ad esempio, si prevede che l'utilizzo dell'AI non possa in alcun modo selezionare con criteri discriminatori, condizionando e restringendo l’accesso alle prestazioni sanitarie. Diventa quindi prioritario il diritto dell’interessato ad essere informato circa l’utilizzo di tali tecnologie. Viene inoltre promossa la diffusione dei sistemi di IA finalizzati all’inclusione, le condizioni di vita e l’accessibilità delle persone con disabilità. Infine, si prevede che l’utilizzo dei sistemi di IA in ambito sanitario debba lasciare impregiudicata la spettanza della decisione alla professione medica. Nel campo della ricerca e della sperimentazione scientifica nella realizzazione di sistemi di intelligenza artificiale in ambito sanitario, assume importanza il trattamento dei dati, anche personali, eseguiti da soggetti pubblici e privati senza scopo di lucro per la ricerca e la sperimentazione scientifica nella realizzazione di sistemi di intelligenza artificiale per finalità terapeutica e farmacologica, che sono dichiarati di rilevante interesse pubblico. Il Ddl, infine, prevede disposizioni in materia di fascicolo sanitario elettronico, sistemi di sorveglianza nel settore sanitario e governo della sanità digitale. Viene a tal scopo istituita una piattaforma di intelligenza artificiale per il supporto alle finalità di cura e, in particolare, per l’assistenza territoriale. Fonte: https://www.governo.it

Statement on the GDPR (General Data Protection Regulation)

The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
