COMMERCIALISTI: IN VIGORE IL NUOVO CODICE DELLE SANZIONI


E' in vigore dal 18 aprile il nuovo codice delle sanzioni, approvato dal Consiglio nazionale dei commercialisti, che si applica in sede di procedimento disciplinare per la determinazione delle sanzioni disciplinari irrogabili agli iscritti in caso di violazione dei principi, degli obblighi e dei divieti stabiliti dal Codice Deontologico della Professione. Il testo segue l'approvazione, avvenuta nelle scorse settimane, del nuovo Codice deontologico, le cui novità sono state ora declinate anche in termini di sanzioni. Le principali novità riguardano innanzitutto le sanzioni relative alle violazioni delle norme sull’equo compenso. E' prevista la censura per entrambe le due possibili violazioni (ossia se il professionista conviene con il cliente un compenso iniquo o se predispone un accordo senza informare il cliente dell’obbligo di rispettare le disposizioni in materia). Prevista inoltre la sospensione fino ad un anno nel caso di esercizio della professione in situazioni di incompatibilità.In tema di obbligo di assicurazione è invece prevista: la sospensione fino a 6 mesi per chi non stipula una polizza; la censura per la mancata comunicazione al cliente degli estremi della polizza sottoscritta.  Relativamente alle violazioni deontologiche, nel caso di più violazioni contemporanee o derivanti dal medesimo fatto si prevede l’applicazione della sanzione prevista per la violazione più grave.Inoltre, si applica: la sospensione fino a tre mesi per il professionista che chieda o riceva da colleghi provigioni o vantaggi per la presentazione di un cliente o per la proposta di incarichi; la sospensione fino ad un anno per chi suggerisce comportamenti fraudolenti; Prevista invece la censura per tutte le violazioni in materia di pubblicità e utilizzo improprio dei titoli professionali. Infine, in merito alle critiche a mezzo social, si passa dalla precedente sanzione della censura ad una sospensione fino ad un massimo di tre mesi. Fonte: https://commercialisti.it

  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
