CORTE UE: LA 'CITYCARD' è UN BUONO MULTIUSO AI FINI IVA


Ai fini Iva, la "citycard" venduta al turista può considerarsi come un "buono", non rilevando il fatto che il titolare non possa usufruire di tutti i servizi proposti.L’emissione di tale strumento, inoltre, non può essere qualificata come "fornitura di un servizio unitario", tenuto conto della diversità dei servizi proposti e degli operatori economici terzi che intervengono in qualità di prestatori.Questo, in estrema sintesi, quanto affermato dalla Corte di Giustizia Europea nella sentenza del 28 aprile 2022 (causa C 637/2020). Più precisamente, secondo la Corte UE, l’articolo 30-bis della direttiva sull'Iva (2006/112/Ce) deve essere interpretato nel senso che uno strumento che conferisce al suo titolare il diritto di usufruire di diversi servizi in un determinato luogo, per un periodo limitato e fino a un certo importo, può costituire un "buono", ai sensi dell’articolo 30-bis, punto 1, di tale direttiva, anche se, a causa della durata di validità limitata di tale strumento, un consumatore medio non può usufruire di tutti i servizi proposti. Tale strumento costituisce inoltre un "buono multiuso", ai sensi della stessa disposizione, ogni volta che l’Iva dovuta su tali servizi non è nota al momento dell’emissione di quest’ultimo.   • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
