DEPOSITARI DI SCRITTURE CONTABILI: APPROVATO IL MODELLO DI CESSAZIONE INCARICO


Con un Provvedimento del 17 aprile l'Agenzia delle Entrate ha approvato il modello, con le relative istruzioni, da utilizzare per la comunicazione di cessazione dell’incarico di depositario di libri, registri, scritture e documenti, prevista dall'articolo 35, comma 3-bis del DPR n. 633/1972.Tale norma prevede la possibilità per il depositario cessato, in caso di variazione del luogo in cui sono tenuti e conservati i libri, i registri, le scritture e i documenti contabili, conseguente alla cessazione dell’incarico di conservazione delle stesse, di comunicare all’Agenzia delle entrate la cessazione dell’incarico, qualora non vi abbia provveduto il contribuente nei termini normativamente previsti. La comunicazione, che il depositario può trasmettere solo a partire dal giorno successivo alla scadenza del termine previsto dal comma 3 del citato articolo 35, deve essere preceduta dall’avviso al cliente depositante dell’intenzione di effettuare la comunicazione stessa all’Agenzia delle entrate. La comunicazione deve essere inviata dal depositario esclusivamente tramite una procedura web, la cui data di attivazione sarà comunicata dall'Agenzia Entrate tramite apposito avviso. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
