RIFIUTO CESSIONE CREDITI GIà ACCETTATI: COME RICHIEDERLO


Con la Circolare n. 6 dell’8 marzo 2024 l'Agenzia delle Entrate illustra le modalità per richiedere il rifiuto delle cessioni dei crediti già accettate, successive alla prima o allo sconto in fattura. In particolare, l'Agenzia risponde in merito a quali soluzioni adottare nei casi in cui: la cessione sia stata accettata per errore dal cessionario, che, invece, intendeva rifiutarla; il cedente e il cessionario, dopo l’accettazione della cessione da parte di quest’ultimo, intendano annullare la comunicazione della cessione del credito effettuata sulla “Piattaforma cessione crediti”. Per i suddetti casi il cedente e il cessionario dovranno richiedere all’Agenzia delle Entrate il “rifiuto” della cessione del credito già accettata, utilizzando l'apposito modello, da compilare secondo le relative istruzioni, e da inviare all'indirizzo PEC annullamentoaccettazionecrediti@pec.agenziaentrate.it.Il modello deve essere sottoscritto digitalmente o con firma autografa dal cessionario e dal cedente. Nel caso di firma autografa, deve essere allegata copia del documento di identità dei sottoscrittori. Da ricordare che la richiesta può riferirsi unicamente a cessioni di crediti successive alla prima o successive allo sconto in fattura, già accettate dal cessionario.Inoltre: qualora la cessione si riferisca a crediti tracciabili, il rifiuto potrà avvenire per ciascuna rata del credito, ove questa non sia stata ulteriormente ceduta, ovvero opzionata per l’utilizzo in compensazione tramite modello F24; in caso di crediti non tracciabili, il cessionario deve disporre di credito residuo sufficiente per la tipologia indicata e la relativa annualità, in quanto verrà ridotto il suo plafond per l’importo corrispondente. All’esito positivo dell’operazione i crediti torneranno nella disponibilità del cedente, ai fini dell’eventuale ulteriore cessione o dell’utilizzo in compensazione tramite modello F24.Una volta eseguita l’operazione tecnica di rifiuto della cessione, ne sarà data comunicazione agli interessati, che potranno comunque consultare lo stato aggiornato della cessione sulla Piattaforma.   • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
