PIATTAFORME E-COMMERCE: OPERATIVA LA DIRETTIVA EUROPEA DAC7. LA COMUNICAZIONE DEI DATI ENTRO IL 31 GENNAIO 2024


Entro il 31 gennaio 2024 i gestori di piattaforme digitali residenti in Italia e, a determinate condizioni, i gestori stranieri “non-Ue” (Fpo), dovranno comunicare all’Agenzia delle Entrate i dati sulle vendite di beni e prestazioni di servizi realizzate dagli utenti attraverso i loro siti e app. Il Fisco italiano, entro il successivo 29 febbraio, condividerà queste informazioni con le autorità degli altri paesi Ue, in base allo Stato di residenza del venditore, ricevendo a sua volta quelle relative ai venditori (persone fisiche o giuridiche) residenti in Italia. Con il Provvedimento del 20 novembre diventa operativa la direttiva europea Dac7 sullo scambio automatico delle informazioni sul reddito degli utenti che vendono prodotti o forniscono servizi attraverso le piattaforme digitali, come recepita nell’ordinamento italiano dal Dlgs n. 32/2023. Rientrano nell’obbligo di comunicazione: l’e-commerce; l’affitto di beni immobili; l’offerta di servizi personali; le attività di noleggio di qualsiasi mezzo di trasporto. Restano fuori dall’obbligo di comunicazione sia i dati relativi ai grandi fornitori di alloggi nel settore alberghiero (quelli con oltre 2mila attività “pertinenti”), sia quelli relativi ai “piccoli inserzionisti”. Il provvedimento chiarisce che sono tenuti all'invio dei dati all’Agenzia delle entrate i gestori di piattaforme residenti ai fini fiscali o costituiti o gestiti in Italia o dotati di una stabile organizzazione nel nostro Paese. I gestori esonerati sono comunque chiamati a inviare una “Comunicazione di assenza di dati da comunicare”. Sono inoltre obbligati alla comunicazione i Foreign Platform Operator (Fpo), ovvero i gestori stranieri non qualificati non-Ue, come, ad esempio, gli operatori che facilitano la locazione di immobili situati in Italia.  Le prime informazioni, relative al 2023, dovranno essere comunicate entro il 31 gennaio 2024. L’Agenzia delle entrate e le altre Autorità degli Stati membri condivideranno i dati relativi ai venditori entro due mesi dalla fine del periodo di comunicazione.   • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
