ENTI ECCLESIASTICI: QUALE CRITERIO PER L'INDIVIDUAZIONE DEL TITOLARE EFFETTIVO?


Tra i chiarimenti forniti lo scorso 20 novembre, contenuti nelle FAQ pubblicate dalla UIF ed elaborate insieme al Ministero dell'Economia e delle Finanze e alla Banca d'Italia, anche i criteri per l'individuazione del titolare effettivo degli enti ecclesiastici. Nella risposta viene operata una distinzione tra gli enti ecclesiastici civilmente riconosciuti ai sensi della Legge n. 222/1985 e quelli non civilmente riconosciuti, ovvero: gli enti ecclesiastici civilmente riconosciuti ai sensi della legge 20 maggio 1985, n. 222 sono tenuti all’iscrizione nel registro delle persone giuridiche tenuto dalla prefettura del luogo in cui hanno sede (D.P.R. 10 febbraio 2000, n. 361). Trova, pertanto, applicazione per tali enti l’articolo 20, comma 4, del d.lgs. 21 novembre 2007, n. 231, ai sensi del quale devono ritenersi titolari effettivi cumulativamente: a) i fondatori, ove in vita; b) i beneficiari, quando individuati o facilmente individuabili; c) i titolari di poteri di rappresentanza legale, direzione e amministrazione. per gli enti ecclesiastici non civilmente riconosciuti trova applicazione il criterio residuale di cui al comma 5 dello stesso articolo 20, secondo cui “il titolare effettivo coincide con la persona fisica o le persone fisiche titolari, conformemente ai rispettivi assetti organizzativi o statutari, di poteri di rappresentanza legale, amministrazione o direzione”. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
