CONTRASTO FRODI IVA: NUOVI OBBLIGHI PER I PRESTATORI DI SERVIZI DI PAGAMENTO


Con il decreto legislativo n. 153 del 18 ottobre scorso sono state recepite le indicazioni della direttiva (Ue) n. 2020/284, che modifica la direttiva 2006/112/CE relativamente all’introduzione di alcuni obblighi per i prestatori di servizi di pagamento (PSP).Le misure di rafforzamento della cooperazione amministrativa per la lotta contro lafrode in materia di Iva, applicabili a partire dal 1 gennaio 2024, sono state inserite nel D.P.R. n. 633/1972, e prevedono che i PSP conservino la documentazione relativa ai pagamenti transfrontalieri e mettano determinate informazioni a disposizione delle rispettive amministrazioni fiscali. Queste ultime, a loro volta, devono trasmettere le informazioni ricevute dai prestatori di servizio di pagamento al sistema elettronico centrale di informazioni sui pagamenti (CESOP),che avrà il compito di archiviare, aggregare e analizzare, in relazione a singoli beneficiari, tutte le informazioni pertinenti in materia di Iva sui pagamenti trasmesse dagli Stati membri.Il CESOP, in questo modo, potrà fornire un quadro completo dei pagamenti che i beneficiari hanno ricevuto da pagatori situati negli Stati membri e mettere i risultati di analisi specifiche delle informazioni a disposizione di Eurofisc, ossia della rete comunitaria di esperti sulle frodi Iva. Il Provvedimento del 20 novembre dell'Agenzia delle Entrate, che si inserisce tra le misure di rafforzamento della cooperazione amministrativa per lottare contro le frodi Iva nel settore e-commerce, definisce le regole per la trasmissione dei dati relativi ai pagamenti transfrontalieri e ai soggetti beneficiari alla stessa Agenzia, che li invierà, a sua volta, al sistema elettronico centrale di informazioni sui pagamenti (CESOP). The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
