RIFORMA FISCALE: LE NOVITà IN TEMA DI CONTENZIOSO TRIBUTARIO


Il Consiglio dei Ministri, nella seduta n. 59 del 16 novembre, ha approvato in esame preliminare due decreti legislativi di attuazione della delega al Governo per la riforma fiscale. Il primo, ai sensi dell’articolo 19 della legge 9 agosto 2023, n. 111, dà attuazione ai principi e criteri direttivi per la revisione della disciplina e l’organizzazione del contenzioso tributario. Di seguito una sintesi delle novità introdotte, come riportate nel Comunicato Stampa del CdM: il coordinamento tra gli istituti a finalità deflativa operanti nella fase antecedente la costituzione in giudizio; l’ampliamento e il potenziamento dell’informatizzazione della giustizia tributaria tramite la semplificazione della normativa processuale funzionale alla completa digitalizzazione del processo tributario, l’obbligo dell’utilizzo di modelli predefiniti per la redazione degli atti processuali, dei verbali e dei provvedimenti giurisdizionali, la disciplina delle conseguenze processuali derivanti dalla violazione degli obblighi di utilizzo delle modalità telematiche, la previsione che la discussione da remoto possa essere chiesta anche da una sola delle parti costituite nel processo, con istanza da notificare alle altre parti, fermo restando il diritto di queste ultime di partecipare in presenza; il rafforzamento del divieto di produrre nuovi documenti nei gradi processuali successivi al primo; la previsione della pubblicazione e della successiva comunicazione alle parti del dispositivo dei provvedimenti giurisdizionali entro termini ristretti; l’accelerazione dello svolgimento della fase cautelare anche nei gradi di giudizio successivi al primo; le previsioni sull’impugnabilità dell’ordinanza che accoglie o respinge l’istanza di sospensione dell’esecuzione dell’atto impugnato.   • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
