NIENTE BONUS 19% PER L'IMMOBILE VINCOLATO: LA COLLOCAZIONE IN ZONA TUTELATA NON è SUFFICIENTE PER ACCEDERE ALLA DETRAZIONE


Con Risposta n. 461 del 14 novembre l'Agenzia delle Entrate chiarisce in merito alla possibilità, da parte del proprietario di una baita alpina («Rascard» del XVI secolo) collocata in area tutelata e che ha effettuato lavori di ristrutturazione per i quali ha dovuto chiedere l'autorizzazione alla Sovrintendenza, di poter fruire della detrazione del 19% prevista dall'articolo 15, comma 1, lett. g) del TUIR per gli immobili vincolati ed i lavori per i quali è obbligatoria l'autorizzazione preventiva da parte della Sovrintendenza. L'Agenzia, sentito il parere tecnico del Ministero della Cultura, ha chiarito che la sola circostanza che un edificio si trovi in corrispondenza di territori costieri, territori montani o parchi naturali non é di per sé sufficiente ad accedere al beneficio fiscale, atteso che la finalità della norma è quella di "agevolare i soggetti tenuti, per legge o in virtù del riconoscimento del Ministero, ad affrontare spese per effettuare lavori di conservazione di beni di interesse culturale". Nel caso di specie, oggetto dell'interpello, non risultava l'interesse culturale dell'edificio né la necessità delle spese effettivamente sostenute sulla base della dichiarazione sostitutiva dell'atto di notorietà presentata alla competente Soprintendenza. L'Istante non può quindi fruire della detrazione dall'Irpef, nella misura del 19% per le spese sostenute sui lavori di recupero e restauro conservativo dell'immobile.
