TOBIN TAX E TRASFERIMENTO DELLE AZIONI: SENTENZA CASSAZIONE


Con Sentenza n. 27265 del 25 settembre 2023 le Corte di Cassazione ha affermato il principio di diritto secondo il quale l’art.1, comma 491, della legge n. 228 del 2012, nell'assoggettare a Tobin tax il trasferimento di azioni, presuppone che cedente e cessionario siano soggetti distinti, evenienza che non ricorre nel caso in cui il passaggio delle azioni avvenga tra due fondi comuni di investimento, che rappresentino, di fatto, patrimoni separati della stessa S.G.R. e le azioni confluite nel nuovo fondo facciano capo agli originari investitori". Sulla base di questo principio la Corte di Cassazione ha respinto il ricorso presentato dall'Agenzia delle Entrate, in quanto non è stato ritenuto soddisfatto il requisito per l'applicazione della Tobin tax, che richiede il trasferimento effettivo del diritto di proprietà delle azioni.   • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
