CREDITO D'IMPOSTA R&S: IN GAZZETTA IL DECRETO CHE ISTITUISCE L'ALBO DEI CERTIFICATORI


Nella Gazzetta Ufficiale n. 258 del 4 novembre scorso è stato pubblicato il DPCM 15 settembre 2023 con le disposizioni in materia di certificazione attestante la qualificazione delle attività di ricerca e sviluppo, di innovazione tecnologica e di design e ideazione estetica, ai fini del riconoscimento del credito d’imposta.Il Decreto, che istituisce l'albo dei certificatori abilitati al rilascio delle certificazioni, definisce la procedura ed il contenuto della certificazione (Art.3) e l'attività di vigilanza sulle attività di certificazione (Art.4).  La certificazione può essere richiesta dai soggetti che abbiano effettuato o intendano effettuare investimenti in attività ammissibili ai fini del riconoscimento dei crediti d'imposta, a condizione che le violazioni relative all'utilizzo di tali crediti non siano state già constatate con processo verbale o contestate con atto impositivo.L'impresa che intenda avvalersi della procedura di certificazione deve presentare una richiesta al Ministero delle imprese e del made in Italy, tramite l'apposito modello, nel quale dovrà essere specificato il soggetto certificatore incaricato dall'impresa per l'esperimento delle attività di certificazione e della dichiarazione di accettazione dell'incarico da parte dello stesso. Oltre alla sottoscrizione, la certificazione deve contenere: le informazioni sulle capacità organizzative e le competenze tecniche dell'impresa richiedente la certificazione o dei soggetti esterni a cui la ricerca è stata commissionata, al fine di attestarne l'adeguatezza rispetto all'attività effettuata o programmata; la descrizione dei progetti o dei sottoprogetti realizzati o in corso di realizzazione e delle diverse fasi inerenti agli stessi ovvero, nel caso degli investimenti non ancora effettuati, la descrizione dei progetti o sottoprogetti da iniziare; le motivazioni tecniche sulla base delle quali viene attestata la sussistenza dei requisiti per l'ammissibilità al credito d'imposta o il riconoscimento della maggiorazione di aliquota; la dichiarazione, sotto la propria responsabilità, da parte del soggetto certificatore, di non versare in situazioni di conflitto di interesse, derivanti anche da rapporti di coniugio o parentela entro il quarto grado, e, comunque, di non avere rapporti diretti o indiretti di partecipazione o cointeressenza nell'impresa certificata o comunque altri interessi economici ricollegabili agli investimenti nelle attività oggetto di certificazione o al soggetto che sottoscrive la relazione tecnica asseverata; tutte le ulteriori informazioni e gli altri elementi descrittivi ritenuti utili dal soggetto certificatore per la completa rappresentazione della fattispecie agevolativa, in funzione delle attività di vigilanza da parte del Ministero delle imprese e del made in Italy e per l'effettuazione dei controlli dell'Agenzia delle entrate sulla corretta applicazione del credito d'imposta.   • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
