DUPLICAZIONE FATTURE EMESSE PER STESSA OPERAZIONE: COME RIMEDIARE ALL'ERRORE


Con la Risposta n. 447 del 13 ottobre 2023 l'Agenzia delle Entrate ha chiarito che la società che, a causa di un errore contabile, trovi nel proprio cassetto fiscale la duplicazione di fatture emesse riguardanti la medesima operazione, può rimediare all'errore tramite la registrazione, nel periodo di imposta corrente, di tutti i duplicati emessi dall'intermediario della controparte e, contestualmente, lo storno dei medesimi mediante l'emissione di nota di variazione ex articolo 26 del decreto IVA, che disciplina le rettifiche in diminuzione dell'imponibile o dell'imposta qualora un'operazione per la quale sia stata emessa fattura ­successivamente alla registrazione venga meno in tutto o in parte ovvero se ne riduca l'ammontare imponibile.Come già indicato nella Risposta ad interpello n. 395/2019, precisano le Entrate, l'errore di duplicazione delle fatture elettroniche emesse può infatti ricondursi a situazioni simili alle cause di "nullità, annullamento, revoca, risoluzione, rescissione". Ciò posto, conclude l'Agenzia Entrate, subordinatamente alla registrazione dei duplicati, la società ha la facoltà di emettere e registrare le note di variazione per lo storno degli stessi.Tali note di variazione possono, inoltre, essere cumulative per ogni codice identificativo IVA di ciascun soggetto acquirente, indicando gli estremi di ciascuna fattura duplicata di cui si vuole stornare l'importo complessivo e, nel campo "causale", la dizione "storno totale delle fatture per errato invio tramite SdI".   • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
