Elenchi Intrastat: le semplificazioni dal 2018


Il 1 gennaio 2018 sono entrate in vigore le misure di semplificazione riguardanti la presentazione e la compilazione degli elenchi riepilogativi delle operazioni intracomunitarie (modelli Intrastat), secondo le disposizioni contenute nel provvedimento n. 194409/2017 emanato dall'Agenzia Entrate, in attuazione alle norme previste dall'art. 50, comma 6 del Dl 331/93 come modificato dal decreto milleproroghe (Dl 244/2016). Tali misure hanno disposto in primo luogo l'abolizione degli elenchi Intrastat degli acquisti di beni e servizi con periodicità trimestrale. Rimane obbligatoria la presentazione degli elenchi Intra mensili, anche se ai soli fini statistici, quando: per quanto riguarda gli acquisti di beni, l'ammontare totale trimestrale di detti acquisti sia, in almeno uno dei quattro trimestri precedenti, uguale o superiore a 200.000 euro (in precedenza il limite ammontava a 50.000 euro). per quanto riguarda gli acquisti di servizi, l'ammontare totale trimestrale di detti acquisti sia, in almeno uno dei quattro trimestri precedenti, uguale o superiore a 100.000 euro Di fatto gli elenchi trimestrali vengono sostituiti dalla comunicazione dei dati fattura (articolo 21 Dl 78/2010 ovvero Dlgs 127/2015). Per quanto riguarda le cessioni di beni ed i servizi resi, rimangono obbligatori gli elenchi da presentare con cadenza trimestrale e mensile. La periodicità di presentazione resta legata al superamento della soglia di 50.000 euro trimestrale. Tuttavia viene introdotta una semplificazione: i soggetti che presentano l'elenco Intrastat delle cessioni di beni con cadenza mensile possono non indicare i dati statistici se tali cessioni non superano, nei quattro trimestri precedenti, un ammontare totale trimestrale uguale o superiore a 100.000 euro. Un'altra semplificazione riguarda il campo "Codice Servizio" (CPA), presente nei modelli INTRA relativi ai servizi (resi o ricevuti), in quanto esso diventa di cinque cifre (in precedenza era di sei cifre) con una riduzione di circa il 50% dei codici CPA da selezionare. Il provvedimento dell'Agenzia prevede, a questo proposito, l'istituzione di un apposito motore di ricerca. Il provvedimento dell'Agenzie Entrate specifica che la verifica del superamento della soglia deve essere effettuato distintamente per ogni categoria di operazioni e che le soglie operano in maniera indipendente: il superamento della soglia per una singola categoria non incide sulla periodicità relativa alle altre tre categorie di operazioni. Ad esempio, se nel corso di un trimestre un soggetto passivo ha realizzato acquisti intracomunitari di beni pari a 300.000 euro e, nel medesimo periodo, ha ricevuto servizi intracomunitari per 10.000 euro, sarà tenuto a presentare mensilmente l'elenco riepilogativo dei soli acquisti intracomunitari di beni, e non quello dei servizi intracomunitari ricevuti). Per le operazioni intracomunitarie svolte fino al 31 dicembre 2017 si applicano ancora le vecchie regole, quindi gli ultimi elenchi Intrastat soggetti a queste ultime saranno quelli scadenti il 25 gennaio 2018.
