ACCERTAMENTO FISCALE: DOCUMENTI NON ESIBITI IN FASE PRECONTENZIOSA INUTILIZZABILI NEL GIUDIZIO TRIBUTARIO


Con Ordinanza n. 6599 del 19 marzo 2026 la Corte di Cassazione è tornata a pronunciarsi in materia e accertamento fiscale, con particolare riferimento agli effetti della mancata esibizione della documentazione contabile nella fase precontenziosa. I giudici di legittimità, richiamando la costante giurisprudenza, hanno chiarito che "la mancata esibizione, nella fase amministrativa che abbia preceduto il giudizio, di atti e documenti rilevanti ai fini dell'accertamento, impedisce di prenderne in considerazione il contenuto a favore del contribuente, se non alla duplice condizione che la documentazione venga depositata in sede giurisdizionale in allegato all'atto introduttivo e che il contribuente medesimo dichiari di non aver potuto adempiere alle richieste degli uffici per causa a lui non imputabile". Dunque, hanno ribadito i giudici di legittimità, il mancato riscontro agli inviti dell?"Amministrazione finanziaria a esibire atti e documenti rilevanti ai fini dell?"accertamento determina l?"inutilizzabilità degli stessi a favore del contribuente nel successivo contenzioso tributario, ai sensi dell?"art. 32, comma 1, nn. 3 e 4, del DPR n. 600 del 1973. Tale effetto sanzionatorio si produce automaticamente in caso di inadempimento ed è rilevabile d?"ufficio in ogni stato e grado del giudizio. Resta ferma, tuttavia, la possibilità di valutare la documentazione qualora venga prodotta in sede giurisdizionale unitamente all?"atto introduttivo del giudizio e il contribuente attesti di non aver potuto adempiere alle richieste dell?"Ufficio per causa a lui non imputabile.   • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
