Notaio e interposizione fittizia di società di servizi - solo per i notai?


Ordinanza Corte di Cassazione 29 gennaio 2021 n. 2084. Sinteticamente Il notaio svolgeva la sua professione e  veniva coadiuvato dalla società P.S. s.r.l. che gli forniva servizi indispensabili per lo svolgimento dell'attività professionale, l'Agenzia delle Entrate riteneva che i redditi della P.S. s.r.l.  (socio unico il coniuge del Notaio, Amministratore il padre del Notaio) dovessero essere imputati al Notaio, ravvisando l'interposizione fittizia della predetta società1. I Giudici di merito hanno rilevato che la condotta negoziale attuata, sebbene sia stata realizzata mediante strumenti giuridici del tutto legittimi, ossia attraverso l'acquisto da parte della società interposta di una serie di servizi, poi girati allo studio notarile P. a prezzi non conformi a quelli di mercato, ha consentito al contribuente di conseguire un notevole risparmio di imposta, previo abbattimento dell'imponibile. e che la contestazione dell'Amministrazione Finanziaria è fondata su presunzioni gravi, precise e concordanti, che sono state riscontrate nella remunerazione dei servizi della società oltre i valori di normalità del mercato, nel basso contenuto specialistico dei servizi, che il notaio avrebbe potuto acquisire direttamente, risparmiando sui costi, nella operatività della società esclusivamente nei confronti del contribuente, nella composizione soggettiva della P.S. s.r.l., il cui unico socio era il coniuge del notaio e amministratore unico il padre del notaio, e ancora nella vantaggiosità fiscale dell'interposizione che ha comportato una dilatazione del reddito della società, soggetto ad aliquota più bassa di quella applicabile al reddito del ricorrente, che è stato conseguentemente ridotto. Note: 1.  art. 37 D.P.R. 600/73 In sede di rettifica o di accertamento d'ufficio sono imputati al contribuente i redditi di cui appaiono titolari altri soggetti quando sia dimostrato, anche sulla base di presunzioni gravi, precise e concordanti, che egli ne è l'effettivo possessore per interposta persona.

  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
