L'UIF PUBBLICA IL MANUALE UTENTE PER LE COMUNICAZIONI OGGETTIVE


Il DL 90/2017 ha apportato diverse modifiche alla normativa antiriciclaggio, tra cui l'obbligo di trasmettere all'Unita di Informazione Finanziaria per l'Italia (UIF), con cadenza periodica, dati e informazioni individuati in base a criteri oggettivi, concernenti operazioni a rischio di riciclaggio o di finanziamento del terrorismo, attribuendo alla stessa UIF il compito di emanare le istruzioni relative al contenuto della rilevazione e alla modalità di trasmissione. Tali dati sono quindi utilizzati da quest'ultima per arricchire l'approfondimento delle segnalazioni sospette e per avviare analisi specifiche su flussi finanziari potenzialmente anomali. La UIF ha recentemente pubblicato l'aggiornamento del Manuale Utente per le Comunicazioni Oggettive, da trasmettere da parte dei soggetti obbligati in via telematica attraverso la rete Internet, mediante il portale Infostat-Uif, previa adesione al sistema di segnalazione online. Le comunicazioni dovranno essere inviate, con cadenza mensile, da banche, Poste italiane, istituti di pagamento e istituti di moneta elettronica e riguarderanno le operazioni in contante pari o superiori a una certa soglia. La trasmissione alla UIF deve essere effettuata dal Responsabile Antiriciclaggio del segnalante ovvero dal Responsabile del punto di contatto (cd. “Referente per le Oggettive”).  Questo soggetto, infatti, è l’interlocutore della UIF per tutte le questioni attinenti alla trasmissione delle comunicazioni e per le eventuali richieste di informazioni, e può inoltre abilitare, sotto la propria responsabilità, altre persone fisiche all’inserimento e alla trasmissione delle comunicazioni oggettive utilizzando le funzioni disponibili sul portale Infostat-Uif. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
