FRINGE BENEFIT AUTO DIPENDENTI: PUBBLICATE LE TABELLE ACI 2022


L'Agenzia Entrate ha reso noto, con apposito comunicato stampa, pubblicato nella Gazzetta Ufficiale, Serie generale n. 307 del 28 dicembre 2021, le tabelle ACI 2022. Le tabelle dell'Aci riportano i costi chilometrici di automobili, ciclomotori e motocicli concessi in uso promiscuo ai dipendenti dai datori di lavoro, valide per il 2022. Le tabelle vengono elaborate dall'Automobile club d'Italia entro il 30 novembre di ogni anno e comunicate al Mef per consentire il calcolo del reddito che deriva dal bene dato in uso. La concessione del veicolo aziendale in uso promiscuo è considerato un fringe benefit soggetto a tassazione, come indicato all' articolo 51 del Tuir. Le tabelle sono adeguate a una importante novità: dal 1° luglio del 2021, infatti, il regime di addebito di questo tipo di benefit prevede gradi di imponibilità inversamente proporzionali al livello di inquinamento del veicolo concesso in uso. L'importo valido come fringe benefit, quindi, deve essere calcolato moltiplicando il costo chilometrico indicato nelle tabelle per 15mila km, che sono ritenuti i chilometri di percorrenza convenzionale per l'uso promiscuo, e applicando la percentuale valida per lo specifico livello di emissioni di Co2:   25% per i veicoli con emissioni non superiori a 60 grammi per chilometro (g/km di Co2) 30% per emissioni superiori a 60 g/km ma non a 160 g/km 50% con emissioni da 160 a 190 g/km 60% per i veicoli con valori di emissione di anidride carbonica superiori a 190 g/km. La modifica apportata dalla legge di bilancio 2020 rientra negli incentivi all'utilizzo di veicoli meno inquinanti. La norma conferma la tassazione forfettaria dei veicoli concessi in uso promiscuo ai dipendenti, ma la percentuale che determina l'imponibile aumenta gradatamente in base al livello di inquinamento provocato, stimato sui valori di emissione di anidride carbonica (g/km di Co2), desumibili dalle tabelle. L'attuale regime deve essere applicato ai veicoli di nuova immatricolazione, concessi in uso ai dipendenti con contratti stipulati a partire dal 1° luglio del 2020. Il valore desunto con i parametri suindicati è del tutto forfettario e prescinde da qualunque valutazione degli effettivi costi di utilizzo del veicolo o della percorrenza che l'utilizzatore effettua realmente.
