GIURISDIZIONE DEL GIUDICE ORDINARIO A DECIDERE SULLE CONTROVERSIE IN MATERIA DI TARIP


Con l’ordinanza n. 11290 del 29.04.2021 le Sezioni Unite della Corte di Cassazione affermano la giurisdizione del giudice ordinario sulle controversie che riguardano la tariffa puntuale (o "corrispettivo") in materia di rifiuti urbani. La predetta pronuncia interviene nell'ambito di una ricostruzione dell'evoluzione, indubbiamente complessa, della normativa in tema di servizio di raccolta e di smaltimento dei rifiuti, e di qualificazione della natura dei relativi costi, che può dirsi ormai aver trovato un duplice approdo: l'uno, preceduto da pronunce contrastanti, in punto di affermazione, da parte delle Sezioni Unite (sentenza 7 maggio 2020, n. 8631) della natura privatistica, con conseguente assoggettabilità ad IVA, ai sensi degli artt. 1, 3, 4, commi 2 e 3 del d. P.R. 26 ottobre 1972, n. 633, della tariffa integrata ambientale (c.d. TIA2), di cui all'art. 238 del d. Igs. 3 aprile 2006, n. 152; l'altro, viceversa, oggetto d'indirizzo interpretativo univoco, relativo all'affermata natura tributaria della tassa rifiuti (cd. TARI), introdotta, in origine, quale componente della imposta unica municipale (IUC), dall'art. 1, comma 639, della I. n. 147/2013, con decorrenza dal primo gennaio 2014, destinata a finanziare i costi del servizio di raccolta e smaltimento dei rifiuti (tra le molte, cfr. Cass., S.U., ord.18 giugno 2019, n. 16341; Cass., S.U., 23 novembre 2018, n. 30426). La Corte Costituzionale, sentenza 16 luglio 2009, n.2, nell'affermare la natura tributaria della tariffa di igiene ambientale (cd. TIA1), quale disciplinata dall'art. 49 del d. Igs. 22 settembre 1997, n.22, quale mera variante della TARSU (Tassa per lo smaltimento dei rifiuti solidi urbani), di cui agli artt. 58 e ss. del d. Igs. 15 novembre 1993, n. 507, evidenziò, quali parametri che debbono indefettibilmente sussistere perché una fattispecie sia qualificata come avente natura tributaria, indipendentemente dal nomen iuris assegnato alla fattispecie, i seguenti elementi: a) la disciplina legale deve essere diretta, in via prevalente, a procurare una definitiva decurtazione patrimoniale a carico del soggetto passivo (doverosità della prestazione); b) la decurtazione non deve integrare una modifica di un rapporto sinallagmatico tra le parti (mancanza di detto rapporto sinallagmatico); c) le risorse, connesse ad un presupposto economicamente rilevante e derivante dalla suddetta decurtazione, debbono essere destinate a sovvenire pubbliche spese (collegamento della prestazione alla pubblica spesa in relazione ad un presupposto economicamente rilevante). Ciò ritenuto ne consegue, secondo il provvedimento in commento, che, avuto riguardo alla tariffa avente natura di corrispettivo, di cui all'art. 1, comma 668, della I. n. 147/2013 (Tarip) la natura privatistica della stessa ne risulti più confermata, con la conseguente applicazione dell’IVA, ed intesa nel senso di delineare l'ambito di detta tariffa in termini alternativi alla tassa sui rifiuti, di cui, come si è visto, è pacifica la natura tributaria. Importante corollario, per quanto riguarda il merito della vicenda è che la non utilizzazione del servizio, ovvero il mancato ritiro dei dispositivi per il conferimento dei rifiuti, non comportano alcun esonero o riduzione della tariffa corrispettiva, che viene applicata per la sola presenza dei presupposti.
