STUDIO ASSOCIATO: Sì ALL'INVIO TELEMATICO DELLE DICHIARAZIONI MA NON ALL'APPOSIZIONE DEL VISTO DI CONFORMITà


Con la Risposta n. 245 del 13 aprile 2021 l'Agenzia delle Entrate ha chiarito che l'associazione che si compone di professionisti (avvocati e commercialisti) iscritti ai rispettivi albi professionali, e che si avvale per il servizio di trasmissione telematica di una società di servizi contabili, il cui capitale sociale è interamente posseduto dai propri associati iscritti nell'albo dei dottori commercialisti, può richiedere l'abilitazione all'invio telematico delle dichiarazioni, a prescindere dalla sua reale composizione interna. Tuttavia, la stessa associazione non può apporre il visto né trasmettere dichiarazioni vistate, mancando il requisito del controllo da parte dei soggetti indicati all'articolo 3, comma 3, lettere a) e b), del DPR n. 322 del 1998. A loro volta i commercialisti associati possono non richiedere una propria partita IVA e utilizzare la partita IVA dell'associazione per l'esercizio della professione ma, nelle attività connesse al visto di conformità, come ad esempio la tenuta della contabilità e la trasmissione telematica della dichiarazione vistata, non possono ricorrere ai servizi dell'associazione, dato che non hanno il controllo della stessa. Diversamente, chiarisce ancora l'Agenzia, potranno utilizzare, come fanno attualmente, la società di servizi le cui quote sono possedute dai commercialisti stessi. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
