Congedo COVID-19 per quarantena scolastica dei figli: novità e chiarimenti


Il Decreto-Legge 8 settembre 2020, n. 111 ha introdotto un congedo indennizzato a favore dei genitori lavoratori dipendenti che necessitano di astenersi dal lavoro in conseguenza all'inizio della quarantena del figlio minorenne fino ai tredici anni, disposta dal Dipartimento di prevenzione della azienda sanitaria locale (ASL) territorialmente competente a seguito di contatto verificatosi all'interno del plesso scolastico.Con la circolare n.132 del 20/11/2020, l'INPS ha fornito alcuni chiarimenti in merito alle modalità di presentazione della domanda di congedo, e ha esteso le casistiche di ammissibilità per tale misura. Si sintetizzano di seguito le principali novità:Ampliamento dei casi in cui è possibile fruire del congedo COVID-19 L'articolo 21-bis del decreto agosto introduce la possibilità di fruire del congedo COVID-19 per quarantena del figlio minore di anni 14, in alternativa allo svolgimento del lavoro in modalità agile, non solo in caso di contatto avvenuto all'interno del plesso scolastico ma anche nell'ambito:dello svolgimento di attività sportive di base o di attività motoria in strutture quali palestre, piscine, centri sportivi, circoli sportivi, sia pubblici che privatidi strutture regolarmente frequentate per seguire lezioni musicali e linguistiche. Si specifica che il congedo per quarantena disposto per contatto verificatosi nei luoghi sopra individuati, diversi dal plesso scolastico, potrà essere fruito solo a partire dal giorno 14 ottobre 2020.Resta ferma la necessità che la quarantena sia stata disposta con provvedimento del Dipartimento di prevenzione della ASL territorialmente competente.Compatibilità con l'altro genitore del congedo COVID-19 per quarantena scolastica del figlio e per sospensione dell'attività didattica del figlio in presenzaIl congedo Covid-19 può essere usufruito rispettando alcune condizioni previste dall'articolo 21 bis del decreto agosto: non è ammesso il contemporaneo svolgimento - da parte dell'altro genitore - di lavoro in modalità agile;non è ammessa la contemporanea fruizione - da parte dell'altro genitore - del congedo per quarantena scolastica per lo stesso figlio o per altri figli relativi allo stesso rapporto familiare;non è concesso il congedo nel caso in cui l'altro genitore non svolga attività lavorativa. È tuttavia concesso di usufruire del congedo Covid-19 anche all'altro genitore a condizione che il congedo sia fruito in relazione alla quarantena scolastica di un figlio minore di quattordici anni avuto nell'ambito di un altro rapporto e che non stia fruendo a sua volta di tale congedo.Modalità di presentazione della domandaLa domanda di congedo per quarantena scolastica del figlio convivente deve essere presentata esclusivamente in modalità telematica attraverso uno dei seguenti canali: tramite il portale web, effettuando l'accesso tramite SPID, utilizzando gli appositi servizi raggiungibili direttamente dalla home page del sito www.inps.it. tramite il Contact center integrato, chiamando il numero verde 803.164 (gratuito da rete fissa) o il numero 06 164.164 (da rete mobile a pagamento, in base alla tariffa applicata dai diversi gestori); tramite i Patronati, utilizzando i servizi offerti gratuitamente dagli stessi.
