NIENTE "BONUS FACCIATE" SE NON C'è IL REQUISITO DELLA VISIBILITà


L'articolo 1, commi da 219 a 223 della Legge n. 160/2019 (legge di Bilancio 2020) ha introdotto una detrazione dall'imposta lorda pari al 90% delle spese documentate sostenute nell'anno 2020 per interventi finalizzati al recupero o restauro della facciata esterna degli edifici esistenti ubicati in zona A o B ai sensi del decreto del Ministro dei lavori pubblici 2 aprile 1968, n. 1444 (cd "bonus facciate"). Con la Circolare n. 2/E del 14 febbraio 2020 l'Agenzia Entrate ha fornito chiarimenti in merito all'applicazione di tale agevolazione precisando che la stessa spetta, tra l'altro, a condizione che gli interventi siano realizzati sull'involucro "esterno visibile dell'edificio, vale a dire sia sulla parte anteriore, frontale e principale dell'edificio, sia sugli altri lati dello stabile (intero perimetro esterno)". Non spetta, invece, per gli interventi effettuati sulle facciate interne dell'edificio fatte salve quelle visibili dalla strada o da suolo ad uso pubblico. Il requisito della visibilità dell'edificio dalla strada o suolo pubblico, dunque, è necessario non solo con rifermento alle facciate esterne, ma anche alle facciate interne dell'immobile. Per questo motivo l'Agenzia Entrate, nella Risposta n. 418 del 29 settembre, ha chiarito che non rientra tra gli interventi agevolabili quello effettuato sull'involucro esterno di un immobile situato al termine di una strada privata, circondato da uno spazio interno e in una posizione di dubbia visibilità dalla strada o dal suolo pubblico.   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
