Minimi e forfetari: cessazione attività e successivo incasso crediti


Oggetto dell'interpello: contribuente in regime dei minimi che aveva cessato l'attività e la partita iva nel 2017 e che ha incassato nel 2019 crediti derivanti da prestazioni 2017 con emissione della fattura nel 2017 - i compensi non erano stati indicati nella dichiarazione dei redditi del 2017 in quanto non incassati. Al contribuente è pervenuta la certificazione dei compensi percepiti nel 2019 ma non può indicare tali compensi nel quadro LM di Unico 2020 in quanto la partita iva risulta cessata nel 2017. Parere dell'Agenzia delle Entrate: viene rammentato che con circolare 17/E del 20 maggio 2012 veniva indicato che veniva ammessa la possibilità per i contribuenti minimi ma anche per i contribuenti forfetari di determinare il reddito relativo all'ultimo anno di attività tenendo conto anche delle operazioni che non hanno avuto in quell'anno manifestazione finanziaria (in parole semplici nella dichiarazione del 2017 il contribuente avrebbe potuto indicare a tassazione anche l'importo delle fatture non incassate). Non avendo più partita iva il contribuente nel modello Unico 2020 indicherà il compenso come reddito diverso, quadro RL rigo RL 15. Visiona l'interpello. Nota dello studio: la soluzione prospettata nell'interpello sembra contraddire quanto indicato nella risposta n. 20 a Consulenza Giuridica - vedi articolo di Fiscooggi - che nonostante sia inerente caso diverso concludeva con In estrema sintesi, i due documenti di prassi chiariscono che, ai fini Iva, l'attività del professionista non può ritenersi cessata fino all'esaurimento di tutte le operazioni, ossia fino a quando non siano stati definiti tutti i rapporti giuridici pendenti connessi alle passate prestazioni professionali, compresi la riscossione di eventuali crediti. Insomma, per chiudere la partita Iva non basta che il contribuente cessi di svolgere la professione.
