Ditte e studi aperti: obbligo di sanificazione


Il protocollo di intesa siglato tra Governo e Parti Sociali il 14 marzo 2020 per il contrasto e contenimento della diffusione del virus negli ambienti di lavoro prevede, per le ditte non interessate dai provvedimenti di chiusura dai DPCM e dal Decreto MISE, una serie di misure quali le informazioni da fornire al personale dipendente, le modalità di accesso dei fornitori esterni, le precauzioni igieniche personali, la gestione degli spazi comuni, i dispositivi di protezione individuali etc. Tra queste misure il punto 4 prevede che "l'azienda assicura la pulizia giornaliera E la sanificazione periodica dei locali, degli ambienti, delle postazioni di lavoro e delle aree comuni e di svago". Tale previsione viene da noi interpretata nel senso che l'azienda (ma alla stessa stregua lo studio professionale) che ha proseguito l'attività non essendo questa stata interessata dai vari Decreti che ne imponevano la chiusura e che non ha volontariamente interrotto l'attività, SIA OBBLIGATA a procedere alla "sanificazione periodica dei locali, delle postazioni di lavoro e delle aree comuni e di svago", che si ribadisce essere, a nostra interpretazione, un obbligo e non una scelta, il termine utilizzato è infatti "assicura"; il contravvenire a tale obbligo potrebbe, ad avviso di chi scrive, eventualmente comportare la rivalsa da parte dell'INAIL e l'eventuale mancato rimborso di polizze assicurative contratte a favore del personale dipendente, per queste ultime occorre verificare le relative clausole di polizza. In tema di sanificazione per l'emergenza COVID-19 è stata emanata dal Ministero della Salute la circolare 5443 del 22/02/2020 che prevede unicamente il caso di pulizia (non viene utilizzato il termine specifico "sanificazione") di ambienti non sanitari ove abbiano soggiornato casi confermati di COVID-19, che tali operazioni siano eseguite da personale dotato di tutti i DPI e precise norme da seguire (mascherine FFP2 o FFP3, camice monouso, svestizione - smaltimento dei DPI monouso come materiale potenzialmente infetto etc.) e effettuate da imprese autorizzate ai sensi del D.M. 274/1997, che al termine dell'intervento rilascino apposita certificazione riguardante l'avvenuto intervento, in conformità alle disposizioni in vigore. Si precisa ancora che a fronte delle spese sostenute per la sanificazione verrà riconosciuto un credito di imposta pari al 50% delle spese stesse, con un massimo di 20.000 euro per impresa/studio, con uno stanziamento attuale di 50milioni di euro, previsto dall'art. 64 D.L. 18/2020.

  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
