Circolare ABI sulla moratoria


L'ABI (Associazione bancaria italiana) in data 24 marzo 2020 ha emanato una circolare sulle misure a sostegno della liquidità per le imprese danneggiate da Covid-19 contenute nel decreto legge 17 marzo 2020, n. 18. La circolare riepiloga e illustra i principali aspetti delle misure di sostegno al credito, coordinandosi con alcune prime indicazioni fornite dal ministero dell'Economia e delle finanze con specifiche Faq del 22 marzo 2020, pubblicate in risposta alle richieste di chiarimenti avanzate anche dall'Abi stessa. Relativamente alle misure di sostegno finanziario (articolo 56, comma 2) l'ABI ha confermato che il rimborso dei prestiti non rateali che scadono prima del 30 settembre 2020 sarà posticipato, senza alcuna formalità, al 30 settembre 2020, alle medesime condizioni. Anche gli eventuali elementi accessori al contratto di finanziamento saranno prorogati senza formalità; per «elementi accessori» si devono intendere tutti i contratti connessi al contratto di finanziamento, tra i quali, in particolare, garanzie e assicurazione (nonché i contratti in derivati). La circolare conferma che potranno richiedere la moratoria le micro, piccole e medie imprese (Pmi), con sede in Italia, appartenenti a tutti i settori, come definite dalla Raccomandazione della Commissione europea 2003/361/CE del 6 maggio 2003, che hanno subito in via temporanea carenze di liquidità per effetto dell'epidemia. Per usufruire delle misure di favore i beneficiari non devono avere posizioni debitorie classificate dalla regolamentazione bancaria come esposizioni deteriorate, ripartite nelle categorie sofferenze, inadempienze probabili, esposizioni scadute e/o sconfinanti deteriorate. Inoltre i "candidati" non potranno avere rate insolute anche parzialmente da oltre 90 giorni. Per ottenere la moratoria i beneficiari dovranno inviare una specifica richiesta via Pec, oppure attraverso altre modalità che consentano di tenere traccia della comunicazione con data certa, autocertificando di aver subito in via temporanea carenze di liquidità quale conseguenza diretta della diffusione dell'epidemia da Covid-19. Le banche saranno tenute ad accettare le comunicazioni di moratoria se rispettano i requisiti, ma non dovranno verificare la veridicità delle autodichiarazioni effettuate dalle imprese.

  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
