Limiti per pagamenti in contanti aggiornato al D.L. 26/10/2019 n. 124 - art. 18


Si rammenta che dal 1° luglio 2018 il pagamento di stipendi, anticipi etc., qualunque sia la tipologia del rapporto di lavoro (incluse le collaborazioni coordinate e continuative, i contratti di lavoro in qualsiasi forma instaurati dalle cooperative con i propri soci), dovrà avvenire con strumenti "tracciabili" (bonifico, strumenti di pagamento elettronici, assegno intestato e consegnato direttamente al lavoratore). LA FIRMA DEL LAVORATORE SULLA BUSTA PAGA NON COSTITUISCE PROVA DELL'AVVENUTO PAGAMENTO DELLA RETRIBUZIONE . In caso di violazione di applica al datore di lavoro la sanzione amministrativa pecuniaria da 1.000 a 5.000 euro, definibile ai sensi della Legge 689/1981 con oblazione entro 60 giorni pari ad un terzo del massimo, cioè 1.667 euro. Sono esclusi dalla disposizione i pagamenti effettuati da soggetti "privati" per gli addetti ai servizi domestici (colf, badanti etc.). Gli assegni bancari e postali superiori a 999,99 euro devono recare lindicazione del beneficiario e la clausola di non trasferibilità (articolo 49 comma 5 del D.lgs. 231). TABELLA LIMITI PAGAMENTI IN CONTANTI Dal 1° gennaio 2022 €. 999,99 Dal 1° luglio 2020 €. 1.999,99 dal 1° gennaio 2016 €. 2.999,99 (2) (3) (4) dal 06/12/2011 al 31/12/2015 €. 999,99 (1) dal 13 agosto 2011 al 5/12/2011 €. 2.499,99 dal 31 maggio 2010 al 12 agosto 2011 €. 4.999,99 dal 25 giugno 2008 al 30 maggio 2010 €. 12.499,99 dal 29 aprile 2008 al 24 giugno 2008 €. 4.999,99 sino al 28 aprile 2008 €. 12.499,99 Note: (1) Non costituisce infrazione il trasferimento di contanti sino a 2.499,99 euro (precedente limite), l'emissione di assegni bancari senza clausola di trasferibilità sino a 2.499,99 euro, il rilascio di assegni circolari sino a 2.499,99 euro, se commesse nel periodo dal 6 dicembre 2011 al 31 gennaio 2012. art. 12 del D.L. 6/12/2011 - conversione in Legge 22/12/2011 n. 214 - G.U. 27/12/2011 n. 300; (2) Comma 898 - 899 L. 28/12/2015 n. 208 - con effetto dal 1° gennaio 2016 - Resta fermo il limite di 1.000= euro per le rimesse di denaro effettuate tramite Money transfer (articolo 49 comma 2 D.lgs. 231 modificato) - Il limite per i cambiavalute corrisponde a 2.999,99 euro (articolo 49 c. 3 del D.lgs. 231 modificato) - Gli assegni bancari e postali superiori a 999,99 euro devono recare lindicazione del beneficiario e la clausola di non trasferibilità (articolo 49 comma 5 del D.lgs. 231 modificato) - E' ammessa unicamente l'emissione di libretti di deposito bancari o postali nominativi - eventuali libretti al portatore dovranno essere estinti entro il 31 dicembre 2018 (articolo 49 comma 12 del D.lgs. 231 modificato); (3) Comma 902 - viene abrogato il comma 1.1 dell'articolo 12 del D.L. 6/12/2011 n. 201 che disponeva il pagamento dei canoni di locazione di qualsiasi importo con sistemi "tracciabili" ed escludendo i contanti. Dal 1° gennaio 2016 il pagamento di canoni di locazione sino a 2.999,99 euro può avvenire per contanti; (4) Comma 903 - viene abrogato il comma 4 dell'art. 32 bis del D.L. 12/9/2014 n. 133 che disponeva per tutti i soggetti della filiera dei trasporti il pagamento di qualsiasi somma in dipendenza di un contratto di trasporto di merci su strada con sistemi tracciabili ed escludendo i contanti - Dal 1° gennaio 2016 tali pagamenti possono essere effettuati in contanti sino alla somma di 2.999,99 euro.
