DEFINIZIONE AGEVOLATA DELLE LITI FISCALI: PER LA CARTELLA NESSUN CONDONO


Con la sentenza n.11975 del 7 maggio 2019 la Corte di Cassazione, Sez. 6 Civile, si è espressa in tema di condono fiscale ed ha chiarito che l'art. 16 della legge 27 dicembre 2002, n. 289, consentendo la definizione agevolata delle sole liti aventi ad oggetto un atto impositivo comunque denominato, non si applica alle controversie riguardanti la cartella, emessa ai sensi dell'art. 36 bis del d.P.R. n. 29 settembre 1973, n. 600 e dell'art. 54 bis del d.P.R. 26 ottobre 1972, n. 633, con cui l'Amministrazione finanziaria richiede il pagamento di versamenti omessi e delle conseguenti sanzioni, poiché tale atto non ha natura impositiva, derivando, per quanto attiene ai versamenti, da una mera liquidazione dei tributi già esposti dal contribuente e, con riferimento alle sanzioni, da un riscontro puramente formale dell'omissione, senza alcuna autonomia e discrezionalità da parte dell'Amministrazione.   • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
