La disciplina transitoria per i rimborsi IVA dopo l'innalzamento della soglia


Il Decreto Legge n. 193 del 2016 collegato alla Legge di Bilancio 2017 ha innalzato da 15.000 a 30.000 euro la soglia entro cui è possibile ottenere il rimborso dell'IVA senza alcun ulteriore adempimento.L'Agenzia Entrate, con la circolare n. 8 del 7 aprile 2017, ha chiarito che l'innalzamento della soglia da 15.000 euro a 30.000 euro esplica i propri effetti anche sui rimborsi in corso di esecuzione alla data di entrata in vigore della disposizione, ossia il 3 dicembre 2016. In particolare, successivamente all'entrata in vigore della nuova disposizione, per i rimborsi per i quali, ai sensi della previgente normativa, occorreva la garanzia, l'ufficio o l'agente della riscossione non procede a richiederla ovvero, se già richiesta, laddove il contribuente non vi abbia già provveduto, non è tenuto a presentarla. Non occorre, altresì, integrare la dichiarazione annuale IVA con il visto di conformità, se mancante, ovvero presentare la dichiarazione sostitutiva di atto di notorietà per beneficiare dell'esonero dalla garanzia. Tuttavia la nuova disciplina non ha effetti sui rimborsi già erogati alla data di entrata in vigore della disposizione che ha innalzato il limite di riferimento, con la conseguenza che le garanzie prestate in corso di validità per i rimborsi già erogati non possono essere restituite. Resta, altresì, confermato il principio secondo cui nel caso in cui sia intervenuta la sospensione degli interessi a seguito di ritardo nella consegna delle garanzie, il periodo di sospensione termina e gli interessi riprendono a decorrere dalla data di entrata in vigore del nuovo testo dell'articolo 38-bis (3 dicembre 2016).

  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
