BONUS IMPRESE PRODOTTI ENERGETICI: COSA FARE IN CASO DI SCARTO COMUNICAZIONI


Sono online sul sito internet dell'Agenzia elle Entrate le risposte alle domande più frequenti in tema di agevolazioni riconosciute alle imprese per le spese sostenute per l’acquisto di prodotti energetici. In una di queste l'Agenzia chiarisce che: se lo scarto della comunicazione, inviata entro il 16 marzo 2023, è dovuto a una delle seguenti motivazioni: la comunicazione è stata presentata da un’impresa che ha un codice ATECO principale non coerente con la tipologia del credito maturato (ma il codice ATECO secondario è pertinente); l’impresa che ha presentato l’istanza non era attiva nel 2022, ma ha diritto alla fruizione del credito per averlo acquisito, a seguito di un’operazione straordinaria, dall’impresa che lo ha maturato nel 2022; il soggetto beneficiario del credito non è titolare di partita IVA attiva, in quanto localizzato nei comuni di Livigno e Campione d’Italia. la comunicazione deve essere trasmessa tramite PEC all’indirizzo cop.Cagliari@pce.agenziaentrate.it, anche successivamente al 16 marzo 2023, compilando lo stesso modello approvato con il provvedimento n. 56785 del 1° marzo 2023.Tale comunicazione deve essere sottoscritta con firma digitale dal beneficiario del credito e il messaggio deve recare nell’oggetto la dicitura “Scarto della comunicazione dei crediti maturati nel 2022 per l’acquisto di prodotti energetici” e il codice fiscale dello stesso beneficiario. In alternativa, il modello può essere sottoscritto con firma autografa, scansionato e trasmesso unitamente alla copia di un documento di riconoscimento in corso di validità. Inoltre, nel messaggio di posta elettronica certificata deve essere indicato il motivo per il quale si chiede l’acquisizione della comunicazione e deve essere allegata la ricevuta di scarto rilasciata dal sistema. La comunicazione può essere trasmessa al medesimo indirizzo di posta elettronica certificata anche per il tramite di intermediari appositamente delegati. Le comunicazioni inviate tramite PEC per motivi diversi da quelli sopra indicati saranno respinte. se, invece, la comunicazione è stata scartata per errori di compilazione, è necessario inviarla nuovamente, entro il 21 marzo 2023, con i dati corretti, utilizzando esclusivamente i canali telematici dell’Agenzia delle entrate o il servizio web disponibile nell’area riservata del sito internet della stessa Agenzia.
