ANTIRICICLAGGIO: PROFESSIONISTI DELEGATI ALLE ESECUZIONI - CURATORI - COMMISSARI


Con il Disegno di Legge n. 2079  Senato si amplierà la platea dei soggetti alle norme antiriciclaggio di cui al d.lgs. 231/2007. Dalla relazione al DDL: “nell'anno 2019 ben 204.632 immobili sono stati oggetto di incanto, per un controvalore di quasi 30 miliardi di euro…..le aste immobiliari  rappresentano un investimento appetibile per chi disponga di ingenti liquidità…..il giudice antimafia Gianfranco Donadio dichiarava che: « Le aste giudiziarie sono uno dei più vasti coni d'ombra del sistema giudiziario. Si tratta di una zona grigia in cui, senza nessuna fatica, si infilano capitali ingenti senza che nessuno riesca davvero a controllare chi compra cosa »…..Esistono sufficienti motivi per ritenere che molto spesso la criminalità organizzata utilizzi questo canale per riciclare i proventi delle attività illecite cui è dedita. La pulizia di tale denaro « sporco » può avvenire sostanzialmente con due diverse modalità: acquistare l'immobile a un prezzo molto basso, alcune volte anche con metodi intimidatori o più semplicemente limitandosi a versare il deposito cauzionale previsto, per poi recuperarlo « pulito » successivamente all'aggiudicazione dell'immobile a terzi.” In base al DDL dovrebbero essere assoggettati alla  normativa ed agli adempimenti conseguenti i professionisti delegati nominati dal Giudice all’esecuzione, i curatori, i commissari giudiziali ed i liquidatori giudiziali nominati dal Tribunale nelle procedure concorsuali. L'articolo 1 estende alle aste immobiliari l'obbligo dell'adeguata verifica della clientela, previsto dall'articolo 17 del decreto legislativo 21 novembre 2007, n. 231, concernente la prevenzione dell'utilizzo del sistema finanziario a scopo di riciclaggio dei proventi di attività criminose e di finanziamento del terrorismo, in attuazione della direttiva 2005/60/CE del Parlamento europeo e del Consiglio, del 26 ottobre 2005, nonché della direttiva 2006/70/CE della Commissione, del 1° agosto 2006, che ne reca misure di esecuzione. Il Giudice dell’esecuzione dovrà inoltre attestare l’avvenuta acquisizione da parte del delegato alla vendita della documentazione di cui al d.lgs. 231/2007. Presso il Ministero di Grazia e Giustizia verrebbe istituita una banca dati per le aste giudiziarie, contenente i dati identificativi degli offerenti, gli estremi del conto bancario o postale utilizzato per versare la cauzione, il prezzo di aggiudicazione dell’intestatario del conto, le relazioni di stima, i dati relativi alle aggiudicazioni ed alle vendite; i dati identificativi degli offerenti, del conto e dell’intestatario saranno messi a disposizione dell’autorità giudiziaria civile e penale.  L’importo della cauzione sarà restituito con le stesse modalità con cui è stata prestata e sul medesimo conto corrente utilizzato per prestarla.

  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
